Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of RoamNumber, a telecommunications service operated by Zero Index Software SAS, a company registered in France (“we”, “us”, “our”).

By creating an account or using RoamNumber, you agree to be bound by these Terms. If you do not agree, you must not use the service.

2. Eligibility

  • You must be at least 16 years old to use RoamNumber.
  • Access to RoamNumber is by invitation only. You may only create an account if you have received a valid invitation.
  • You must provide accurate and complete information when creating your account and keep it up to date.

3. Description of Service

RoamNumber allows you to:

  • Purchase and manage virtual phone numbers
  • Send and receive SMS and MMS messages
  • Make and receive voice calls via WebRTC
  • Look up carrier and portability information for phone numbers

The service relies on third-party telecommunications infrastructure provided by Telnyx. Availability, features, and supported regions are subject to the capabilities of our underlying providers.

4. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately at support@roamnumber.com if you suspect unauthorized access to your account.
  • You may not share your account with others or transfer your account to another person.

5. Acceptable Use

You agree not to use RoamNumber to:

  • Send unsolicited bulk messages (spam), including commercial, political, or promotional messages to recipients who have not consented to receive them
  • Engage in any form of harassment, threats, or abuse via messages or calls
  • Impersonate any person or entity, or misrepresent your identity or affiliation
  • Transmit any content that is illegal, harmful, defamatory, obscene, or otherwise objectionable
  • Violate any applicable telecommunications laws or regulations, including those governing robocalling, telemarketing, and consumer consent (e.g., TCPA in the United States, ePrivacy Directive in the EU)
  • Use the service for any form of fraud, phishing, or social engineering
  • Interfere with or disrupt the service, servers, or networks connected to the service
  • Attempt to gain unauthorized access to any part of the service or its related systems
  • Use automated systems (bots, scripts, scrapers) to access the service without our prior written consent
  • Resell or redistribute the service or phone numbers to third parties without our authorization

We reserve the right to suspend or terminate your account if we determine, at our sole discretion, that you have violated these acceptable use policies.

6. Phone Numbers

  • Phone numbers purchased through RoamNumber are provisioned via Telnyx and are subject to Telnyx's terms and applicable telecommunications regulations.
  • You do not own the phone numbers. You are granted a license to use them for the duration of your subscription.
  • We may reclaim or reassign phone numbers that have been released or associated with suspended/terminated accounts.
  • Phone number availability and pricing are subject to change without notice.

7. Fees and Payment

Phone number purchases and telecommunications usage (messages, calls) are billed through our platform. We reserve the right to modify pricing at any time. Material changes to pricing will be communicated to you in advance.

You are responsible for all charges incurred through your account, including any taxes or regulatory fees that may apply.

8. Service Availability

We strive to provide reliable service, but we do not guarantee uninterrupted or error-free operation. The service may be temporarily unavailable due to:

  • Scheduled or emergency maintenance
  • Third-party service disruptions (including Telnyx outages)
  • Force majeure events

We are not liable for any damages resulting from service interruptions or delays in message or call delivery.

9. Content and Communications

  • You retain ownership of the content you send through RoamNumber.
  • By using the service, you grant us a limited license to process, transmit, and store your content as necessary to provide the service.
  • We do not monitor the content of your messages or calls. However, we may review content if required by law, court order, or to investigate violations of these Terms.

10. Privacy

Your use of RoamNumber is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the service, you acknowledge that you have read and understood our Privacy Policy.

11. Intellectual Property

The RoamNumber service, including its design, code, features, and branding, is owned by Zero Index Software SAS and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the service.

12. Termination

12.1 By You

You may stop using the service at any time. To delete your account, contact us at support@roamnumber.com. Upon account deletion, your phone numbers will be released and your data will be handled in accordance with our Privacy Policy.

12.2 By Us

We may suspend or terminate your account at any time, with or without notice, if:

  • You violate these Terms or our acceptable use policies
  • We are required to do so by law or regulatory order
  • We discontinue the service or any material part of it

Upon termination, your right to use the service ceases immediately. We may delete your data after a reasonable retention period, subject to any legal obligations to retain it.

13. Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, secure, or error-free, or that messages will be delivered within any specific timeframe.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Zero Index Software SAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the service.

Our total liability for any claim arising from or related to these Terms or the service shall not exceed the total amount you have paid us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable French or EU law.

15. Indemnification

You agree to indemnify and hold harmless Zero Index Software SAS, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Content you transmit through the service

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice on the service at least 30 days before the changes take effect. Your continued use of the service after the changes become effective constitutes acceptance of the revised Terms.

17. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or the service shall be submitted to the exclusive jurisdiction of the competent courts of Paris, France. This does not affect your rights as a consumer under mandatory provisions of the law of your country of residence.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
